00:00:09:11 - 00:00:27:18 Unknown hey, Foreclosure fix family. Welcome to the Foreclosure Fix podcast, where our goal is to help 1 million homeowners successfully navigate foreclosure. I'm your host, D.J. El Ojo. And if this mission resonates with you, please do us a favor, like subscribe and tell a friend that we are here to help.
00:00:27:20 - 00:00:50:03 Unknown I am fired up today because I have my homegirl, one of my favorite attorneys in the whole wide world. I love getting the chance to see her at conferences because she is full of knowledge and experience, but she also is just so down to earth and so I'm happy to have on the podcast today. Aaron Quinn. And welcome to the Foreclosure Fix family.
00:00:50:04 - 00:00:55:18 Unknown How you doing?
00:00:55:20 - 00:01:09:08 Unknown Well, now is definitely true. You are always a ball of energy and you always have the best stories. So I know our audience is in for a ride today on today's podcast. So Erin
00:01:09:08 - 00:01:18:26 Unknown is an attorney. And before we go any further, I know she's going to give you a disclaimer, but let me give you a disclaimer. Erin is an attorney, but she is not your attorney.
00:01:19:01 - 00:01:41:01 Unknown So if you have a legal question or you are, listen to what she's saying. It cannot be construed as legal advice. All right. She is here just giving information. And we always tell people, if you have a foreclosure situation and you want an expert opinion, please talk to attorney who can understand all the specifics of your situation. It's so important.
00:01:41:04 - 00:01:58:26 Unknown Context matters. With that being said, Eric Quinn is an attorney licensed in Florida, Georgia, and I think the District of Columbia. She graduated from the University of South Florida and then also attended Stetson University College of Law, where she received her juris doctorate.
00:01:58:26 - 00:02:09:17 Unknown So she is an experienced professional who does this type of work. And so Aaron, let our listeners know how you and your firm, Quinn Legal, interact with borrowers in foreclosure.
00:04:15:19 - 00:04:25:02 Unknown Awesome. Awesome.
00:04:25:02 - 00:04:29:17 Unknown That's phenomenal. Right? And so help our listeners understand what
00:04:29:17 - 00:04:40:17 Unknown loss mitigation means. Right? You said that were. I know some people don't even know what that is. So help our listeners saying what loss mitigation is.
00:05:08:05 - 00:05:10:02 Unknown Awesome. Awesome. So
00:05:10:02 - 00:05:18:27 Unknown sometimes there is a lot of confusion from homeowners when they are in foreclosure about who they should be talking to, what's going on.
00:05:18:28 - 00:05:33:20 Unknown And I think your firm and your experience alluded to the issues they have is that they want a resolution, they want something to happen. They want to save their house. But in their conversation with the servicer, the bank,
00:05:33:20 - 00:05:36:23 Unknown and in rare instances, the actual
00:05:36:23 - 00:05:51:20 Unknown owner of the know or deed of trust or mortgage, they are lost. Right. And so help us understand the role of a firm like yours versus the other parties in the mix,
00:05:51:20 - 00:06:00:17 Unknown The defense counsel, the servicer, the actual investor.
00:06:00:17 - 00:06:12:26 Unknown Right. Help us help us understand where you fit in right. Or where where your firm fits in. But then more importantly than that, when when a homeowner is trying to get through the process, what can
00:06:12:26 - 00:06:15:17 Unknown people in your shoes do for them?
00:06:15:17 - 00:08:24:26 Unknown Yep. Yep.
00:08:24:26 - 00:08:28:17 Unknown Absolutely. So I'm a homeowner in foreclosure.
00:08:28:17 - 00:08:33:05 Unknown I get a piece of paper from Quinn Legal on it and it says,
00:08:33:05 - 00:08:37:04 Unknown you owe $100,000 for this house.
00:08:37:04 - 00:08:43:26 Unknown You need to pay us $10,000 within 30 days to reinstate your loan. Right.
00:08:43:26 - 00:08:44:26 Unknown What do I do?
00:12:09:29 - 00:12:12:08 Unknown Very good explanation there.
00:12:12:08 - 00:12:24:24 Unknown One of the things that I hear a look like you're you're on the podcast for a reason, right? I only want I only want the best talkers, Right?
00:12:24:27 - 00:12:29:06 Unknown You litigate to.
00:12:29:08 - 00:12:30:11 Unknown So no.
00:12:30:11 - 00:12:38:11 Unknown One of the common misconceptions I hear from people who I've either work with or comments that we get or whatever else might be the case is
00:12:38:11 - 00:12:39:08 Unknown that
00:12:39:08 - 00:12:49:27 Unknown the bank is out to get me or they just don't like me. That's why they're doing this. Help people understand your firm's perspective or people in your shoes firm's perspective.
00:12:49:27 - 00:13:01:17 Unknown Like when you're doing going through your daily task list, when your team is doing what they do. Like, what's the perspective for you all? Is it just the job is there, You know, like help help people understand that?
00:13:48:26 - 00:14:38:05 Unknown Yeah.
00:19:02:04 - 00:19:04:16 Unknown Gotcha. And so who pays for you
00:20:24:04 - 00:21:01:03 Unknown actually makes.
00:21:01:05 - 00:21:19:09 Unknown No, I totally understand. So I'm a homeowner. I'm scare area. I get the letter. I'm shaking in my boots like I got financial pressures on me. I'm just, you know, I'm pissed off. I'm mad at the world. And, you know, I don't want to deal with this. I don't. My life is not where I planned it to be at this very moment.
00:21:19:10 - 00:21:19:25 Unknown Right.
00:21:20:16 - 00:21:26:10 Unknown What can you do to help me? Like, what does a successful workout look like? What
00:21:26:10 - 00:21:31:07 Unknown kind of help us understand that? So I get the letter. I call your office and like, you know,
00:21:31:07 - 00:21:43:13 Unknown I have no money. I I'm working on it. I'm trying to figure it out. Like, what does a successful workout look like in that scenario?
00:25:02:05 - 00:25:27:11 Unknown Mm hmm.
00:25:27:13 - 00:25:49:07 Unknown It's
00:28:42:16 - 00:29:27:22 Unknown yep. Yep.
00:29:28:01 - 00:29:38:22 Unknown Yeah,
00:29:38:22 - 00:29:54:22 Unknown absolutely. So you said some things that I really want to highlight and I really want people to understand. The first thing Erin reiterated, what I was like to say is you need to make a decision. Are you going to keep your house or are you going to let it go? That decision needs to be made and then you can know how to move forward.
00:29:54:28 - 00:29:58:04 Unknown That was the first thing. The second thing you said is
00:29:58:04 - 00:30:01:10 Unknown the longer the foreclosure process takes,
00:30:01:10 - 00:30:04:16 Unknown the less negotiable the bank becomes.
00:30:04:16 - 00:30:13:13 Unknown Right. And I think homeowners really need to understand this, because if a bank's willing to take a loss on your loan for settling early,
00:30:13:13 - 00:30:15:13 Unknown once the process is extended
00:30:15:13 - 00:30:24:17 Unknown and delay and they have a lot more energy, effort, time, legal expenses and everything into the case, that settlement offer does not stay the same.
00:30:24:21 - 00:30:47:27 Unknown It changes. It changes. It changes. And also market conditions don't stay the same. If they start this process two years ago and the market is, you know, at one point and two years later, now the market is up or down, a lot of different variables change. And so you have to understand that it's better to find a resolution sooner than it is to wait and delay until later.
00:30:48:02 - 00:31:16:28 Unknown Right. And so and so,
00:31:25:13 - 00:33:18:13 Unknown yeah.
00:33:46:28 - 00:34:01:06 Unknown Yeah, I get it
00:34:35:12 - 00:34:43:18 Unknown Awesome. So, Aaron, you know, what would you say your favorite part about working with homeowners is?
00:36:45:10 - 00:36:50:08 Unknown Mm hmm.
00:37:27:11 - 00:37:35:08 Unknown Taking.
00:38:49:20 - 00:39:05:20 Unknown Yeah, yeah, yeah. As I.
00:39:05:20 - 00:39:47:08 Unknown Mm hmm. Yeah.
00:39:47:29 - 00:40:08:06 Unknown No, absolutely. Aaron And I appreciate that, that explanation, because I think a lot of people, they're just frustrated. They're mad. I know you've probably been cast out tons of times of people calling your firm. And so I get it. I understand both sides of the equation equation. And sometimes that that frustration is just misplaced.
00:40:08:08 - 00:41:19:00 Unknown And it's it's very difficult. Yeah, exactly. Yeah. Yeah. 100%. And it sounds like you've been getting teary eyed as you kind of talk about it. So I. Well. Well, Aaron, that brings us to, like, my favorite part of podcast, which is, you know, our bow tie around, which, you know, is an opportunity. It's an opportunity for our listeners to tie went on with you.
00:41:19:01 - 00:41:37:17 Unknown Right. And so the be in the bow tie round stands for the best advice you have for someone in foreclosure. The O stands for one thing you're grateful for, and the W stands for your wildest or most interesting foreclosure related story. All right, so B, what's your best advice for someone in foreclosure?
00:42:31:08 - 00:43:37:06 Unknown Absolutely. The o one thing you are grateful for right now, that's awesome.
00:43:37:06 - 00:44:00:23 Unknown And Kelly is an amazing person. Hey, no, I appreciate it, but no, Kelly is Kelly. Kelly is pretty cool when I can't find her. And Queen, I know. I call Kelly and Kelly helps me finder so now I appreciate it. The last thing is you're wow. It is our most interesting foreclosure related story.

00:44:24:27 - 00:44:30:14 Unknown Yeah.
00:45:24:17 - 00:45:26:11 Unknown Wow.
00:47:37:05 - 00:47:46:20 Unknown Yeah.
00:48:06:26 - 00:48:19:08 Unknown Wow.
00:48:54:06 - 00:48:57:14 Unknown Mm hmm. Yeah.
00:50:08:00 - 00:50:35:23 Unknown What? Wow. So note to self. Do not become a foreclosure attorney. I'm taking it off my list. Thank you so much for that. Help.
00:50:35:26 - 00:50:55:28 Unknown 100%. There's a lot of firms in Atlanta who do that exact same thing where, you know, you can't you can't even. It's like. Like you're going into the White House.
